Federal Court of Australia — ASIC v McIntyre [2016] FCA 1276
On 17 October 2016, the Federal Court declared Jamie McIntyre's 21st Century land banking schemes to be unlawful unregistered managed investment schemes. More than $7 million was lost across 152 Australian families. Both Jamie and Dennis McIntyre were banned for 10 years.
““It is clear that both Mr Jamie McIntyre and Mr Dennis McIntyre are, at the absolute least, financially incompetent. Unless they learn new skills and become diligent and competent, they will be a danger to investors.”
Court-ordered bans include:
- Ban on running companies (10 years)
- Ban on promoting or advising on financial products (10 years)
- Ban on operating a financial services business
- Ban on using online platforms to present himself as offering investment or real estate investment services
The court warned that any breach carries a “high risk of imprisonment.”
The 5 Unlawful Land Banking Schemes
The Federal Court identified five specific land banking developments operated through Jamie McIntyre's 21st Century Group, all declared to be unregistered managed investment schemes. Investors were lured by promises of windfall profits from rural land set to be rezoned for housing and commercial development.
- Botanica — 805 Archer Rd, Kialla, Victoria
- Secret Valley Estate — 955 Old Sydney Road, Bylands, Victoria
- Oak Valley Lakes Estate & Resort — 124 Booth Road, Brookhill, Townsville, QLD
- Bendigo Vineyard Estate & Resort — 51 Andrews Road, Bendigo, Victoria
- Melbourne Grove Estate — 1491 Dohertys Road, Mount Cottrell, Victoria
Joint liquidators Simon Wallace-Smith and Robert Woods (Deloitte) were appointed. Liquidators were unable to locate more than $7 million outlaid by investors.

ASIC Regulatory Action
The Australian Securities and Investments Commission (ASIC) pursued enforcement action resulting in the 10-year disqualification. McIntyre's conduct was labelled 'serious irresponsibility.' ASIC's investigation followed a Fairfax Media expose that revealed hundreds of unsophisticated investors were lured into the schemes.
Senate Committee — Scrutiny of Financial Advice
The Senate Committee inquiry heard victim impact statements submitted by McIntyre's own legal team. Multiple senators expressed serious concerns about McIntyre's conduct.
““I am a single mother and do not want to lose the money I have invested.”
““In my seven years in the Senate, you would have to be the most evasive witness I have had to deal with and that's saying something.”
Current Allegations — Bali (2025)
Construction Payment Dispute — ~$900,000 AUD
Balinese builder Made Mwrna (also reported as Mr Made Murna Wijaya) is claiming approximately $900,000 in unpaid construction fees for villas advertised as Seminyak Studios. A Current Affair confirmed McIntyre is currently defending a civil lawsuit in Denpasar District Court.
““I cannot pay all the workers because of this case. I cannot pay all the suppliers and also all the subcontractors.”
““We have built honestly, we have paid our workers, and we have carried the project forward in good faith. But without the funds owed, my company, my staff, and our families are now at risk.”

McIntyre rejected the allegations, claiming he was actually owed money by the builder.
Location Misrepresentation — Seminyak vs Kerobokan
Properties marketed as 'Luxury Seminyak Villas' and 'Seminyak Studios' but official land certificates show the location as Kerobokan, close to Bali's main prison.
““We paid for Seminyak luxury. The certificate shows a different suburb near the jail. We just want accurate information and clarity.”
McIntyre's response (via email to A Current Affair):
“Half the famous Seminyak restaurants aren't within the technical boundaries of Seminyak. They are in an area considered to be an area of Seminyak so there is nothing misleading to suggest it's not Seminyak.”
Marina Bay City — Lombok Project Halted
Construction on another McIntyre project called Marina Bay City on the island of Lombok was halted in November due to issues with local permits. McIntyre claims construction has restarted on one section, though many investors are reportedly nervous.

Embezzlement Allegations — Kinnara Police Report
McIntyre's joint venture partners, Kinnara, have lodged a complaint with Bali Police alleging embezzlement of funds. Bali Police confirmed they are investigating and have interviewed Jamie McIntyre as a witness, not a suspect.
““We went straight to Jamie and we asked for him to explain those transactions, unfortunately an explanation was not provided. So at that point we engaged our legal counsel who advised us to actually lodge a police report.”

McIntyre said there was “nothing to it” regarding the alleged embezzlement, instead accusing Kinnara of improper conduct.
Dennis McIntyre — Criminal Conviction
Dennis McIntyre Convicted of Child Sex Offence
Jamie McIntyre's brother and business partner Dennis McIntyre is serving a minimum two-year sentence in a NSW prison after being convicted of grooming a 15-year-old girl into having sex with him. He was aged 40 and married at the time. He pleaded guilty in Armidale District Court.
““The offender embarked on sexual exploitation of this young girl.”
